GENERAL LIABILITY & INDEMNIFICATION Photographer will take all reasonable care in the production of the Image(s) and the performance of this agreement. But, Photographer will not be liable for any loss, damages, or costs, suffered by Client, or by any third party, arising from Client’s use of any services. The customer, and related parties herby agree to protect, indemnify, and hold Mallory Christine Photography harmless. The customer is accepting responsibility, and providing payment for “related parties” invited to participate in services. The customer and related parties herby recognizes that Mallory Christine Photography is a lifestyle photography company, which operates in inherently high-risk environments. The purpose of this Terms of Service acknowledgment is to exempt, waive, and release Mallory Christine Photography from any and all liability for wrongful death, personal injury, and property damage, including, but not limited to liability arising from requested services; and transfer the risk of loss arising out of the participation, to the Customer, and related participants. For weddings and/or elopements, clients agree to obtain any necessary permissions or permits required for the photographer to be present at the wedding or elopement location. It is the client's sole responsibility to ensure that all necessary approvals are in place prior to the event. The customer must agree to this Terms Of Service acknowledgment for services to be rendered. FORCE MAJEURE In the very unlikely event of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid. DIGITAL FILES All digital files remain the property of the photographer. Client(s) will receive a full download of the edited photos (no less than 75 for full sessions). Client is aware that optical, magnetic, electronic, and any other media for storing digital data are inherently unstable. Client hereby releases Photographer and her contractors, and representatives, from any liability for any claims, damages, or costs, arising from any media supplied by Photographer becoming unusable. All digital files created that contain any Image(s) will be deleted or destroyed within ten days after the expiration of gallery. Gallery will be available to Client for 2 months. Photographer cannot guarantee the availability of any Image(s) beyond the 2 month period to Client. PUBLIC DISPLAY The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums, social media, etc. without notification. CREATIVE LICENSE, COVERAGE AND REPRODUCTION Photographs taken during the course of a photoshoot will be at the discretion of the photographer, although every effort will be made to comply with the clients’ requirements. Special requests are not binding instruction, although every effort is made to comply with the client's wishes. The Photographer will do their best to honor the requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangements due to changes in weather and the availability and willingness of subjects. Due to a variety of lighting conditions and the limitations of digital sensors, some colors may alter throughout a set of photographs. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure. PAYMENT A non-refundable booking fee of $50.00 will confirm your booking, as well as full acceptance of the terms and conditions as written within this document. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due. Client agrees to pay Photographer all fees at time of photo shoot and expenses in connection with said assignment, whether or not Client uses any Image(s). CANCELLATION & RESCHEDULING FEES If the client(s) should have to cancel, the $50 deposit will be retained as a cancellation fee. There will be no fee for rescheduling before the shoot unless the photographer is en route. In that case, there will be a mileage fee. TRAVEL Travel within Summit County is free of charge. Outside of Summit county, client(s) will pay a fee of .78 cents per mile and $25 per hour of travel from Silverthorne, CO. DELIVERY The photographer will deliver digital files through an online gallery as quickly as possible. Online gallery will be delivered no later than 4 weeks after the photoshoot date.
